Rule 4
4 Suspendable
: (1) A person who is accused of not following professional conduct or who has been registered in accordance with clause (e) of sub-section (1) of section 18 of the Act may be suspended from being a registered pharmacist or pharmacy assistant by the investigation committee from the date of commencement of the investigation. .t दधादध.बिधायम्षककष्याल.याखक.लू।।।।
(a) if, by allowing him to carry on the business of pharmacy without suspension, it is likely that false evidence will be collected or evidence against him will be destroyed, or
(b) If there is a possibility of causing harm to the business or the consumer by allowing the pharmacy to do business without suspension.
(2) Suspension of a pharmacy practitioner in accordance with sub-rule (1) should not normally be for a period exceeding two months. Within that period, the action related to the charges against him should be stopped. In case of any extraordinary circumstances, the proceedings cannot be terminated within that period and the period of suspension needs to be extended, the period of suspension can be extended for a maximum period of one month with the prior approval of the Council.
(3) In case of suspension as per sub-rule (1) or extension of the period of suspension as per sub-rule (2), the relevant pharmacy practitioner and if he/she is employed in any organization, that information shall be given to such organization. After receiving the information to suspend a pharmacy professional, such organization should also suspend the related pharmacy professional from the service of their organization.
(b) If there is a possibility of causing harm to the business or the consumer by allowing the pharmacy to do business without suspension.
